Deed – Secretary of State, New York. Deed Book 11, pgs 62 This Indenture made in the city of New York on the twenty
third day of November in the seventh year of her Majesty’s reign A.D. one
thousand seven hundred and eight between Sarah Schouten of the said City
aforesaid Widow of the one part and the Ministers Elders and Deacons of the
Dutch Reformed Protestant Church of the City of New York of the other part Whereas Frederick Lubberts of Long Island did by his
certain deed under his hand and seal bearing date the twenty ninth day of
January in the year of our Lord one thousand six hundred and seventy nine for
the consideration therein mentioned and exprest did give grant bargain and sell
unto John Schouten of the City aforesaid Carpenter his heirs and assigns forever
all that a certain household lot of ground and premises situate lying and being
within the City aforesaid in the Street commonly called and known by the name of
Pearl Street And whereof the said John Schouten being so seized and
possest of the premises on the ninth day of March in the year of our Lord one
thousand six hundred and eighty five/six being then of sound memory and
understanding did make his last Will and Testament in writing and then soon
after died And therein and thereby did bequeath all his estate both real and
personal unto the said Sarah Schouten his now widow with full power to sell and
dispose thereof as she should think fit, which said Will and Testament was
afterwards (to wit) on the seventeenth day of March in the year of our Lord one
thousand six hundred and eighty nine and ninety in due form proved and approved
as in and by the said Will and Testament and the probate thereof relation being
thereto may more fully and at large appear And mow this Indenture witnesseth that the said Sarah
Schouten for and in consideration of the sum of twenty pounds good and lawful
money of New York to her in hand well and truly paid at and before the ensealing
and delivery of these presents by the Ministers Elders and Deacons of the Dutch
Reformed Protestant Church of the City of New York the receipt whereof she doth
hereby acknowledge and holdeth herself therewith fully satisfied and contented
and thereof and therefrom and of and from all and every part and parcel thereof
doth fully and absolutely exonerate and discharge the said Ministers Elders and
Deacons and their successors and assigns forever by these presents have given
granted enfeoffed confirmed bargained and sold and by these presents doth fully
and absolutely give grant enfeoff confirm bargain and sell unto the said
Ministers Elders and Deacons of the Dutch Reformed Protestant Church of the City
of New York aforesaid their successors and assigns forever all that the before
mentioned house and lot of ground and premises together with all and every its
appurtenances and all the estate right title interest possession claim and
demand of her the said Sarah Schouten of and in or to the same and the reversion
and reversions, remainder and remainders rents issues and profits thereof and of
every part thereof To have and to hold the above granted house and lot of ground
and premises unto them the said Ministers Elders and Deacons their successors
and assigns to the only and proper use and behoof of them the said Ministers
Elders and Deacons their successors and assigns forever And the said Sarah Schouten for herself and her heirs doth
hereby covenant promise and grant to and with the said Ministers Elders and
Deacons and their successors and assigns that she the said Sarah Schouten is at
and before the ensealing and delivery hereof rightfully and lawfully seized of
and in the hereby to be granted premises and hath in herself good right full
power and lawful authority thereof to dispose and that the same and every part
thereof now and forever hereafter shall so remain freely acquitted and
discharged or otherwise sufficiently saved harmless unto the said Ministers
Elders and Deacons and their successors and assigns of and from all and other
gifts grants bargains sales dowers jointures mortgages statutes recognizances
judgments executions extents and of and from all other incumbrances whatsoever
had made procured committed suffered or done by her the said Sarah Schouten or
with her privity or consent or by or from any other person or persons whatsoever And that it shall and may be lawful to and for the said
Ministers Elders and Deacons and their successors or assigns from henceforth and
forever thereafter peaceably and quietly to have hold use occupy possess and
enjoy the hereby granted premises without the least lot hindrance or molestation
of her the said Sarah Schouten or by or from any person or persons claiming or
which might hereafter claim by from or under her or by from or under any other
person or persons whatsoever provided nevertheless and it is the true intent and
meaning of these presents that if the above named Sarah Schouten her heirs
executors or administrators or some of them shall and do well and truly pay or
cause to be paid unto the before named Ministers Elders and Deacons their
certain Attorney successors or assigns the full and just sum of twenty one
pounds four shillings current money of the Province of New York on or before the
twenty third day of November which shall be in the year of our Lord one thousand
seven hundred and nine without fraud covin or further delay that then this
present Deed of Mortgage and every article and clause therein contained shall
become utterly void and none effect any thing herein contained to the contrary
hereof in any wise notwithstanding otherwise to be and remain in full force and
virtue In testimony whereof the parties to these presents Indenture have interchangeably put their hands and seal the day and year first above written Sarah Schouten her mark (seal) Sealed and delivered in the presence of Joshua De
