The Last Will and Testament
of
Thomas Turney  -  1777

 

In The Name Of God Amen I Thomas TURNEY late of Potsgrove but now of Ridgemont in the County of Bedford Yeoman being sick and weak of body but of sound and disposing mind memory and understanding (praised be God for it) Do make publish and declare this my last Will and Testament in manner and form following (that is to say first and principally I Command my Soul into the hands of Almighty God that gave it assuradly believing I shall receive full pardon and Remission of all my sins and be saved by the alone? Merits and Mediation of my blessed Son Savior and Redeemer Jesus Christ and my body it Commit to the Earth to be decently buried according to the Discretion of my Executor herein after named and as to such Worldly Estate with which it hath pleased Almighty God to bless me with I give and dispose thereof in manner and form following that is to say

First I will that all such debts as I shall firstly owe at the time of my decease and my funeral Charges and Expenses be in the first place paid and satisfied by my Executor herein after named out of my personal Estate

Also I give and bequeath unto my late Servant Mary IMPEY for her faithful services the sum of two hundred pounds of good and lawful money of Great Britain (On condition she delivers up to my Executor herein after named my Note or Security which I have already given her for that sum before the publishing of this my last Will but not otherwise

Also I give and bequeath unto my Nephew Thomas TURNEY the sum of seven hundred pounds of like money subject nevertheless to and charged and chargable to and with the payment of one annuity of five pounds a year unto my Niece Mary BRIGG and her assigns for and during the term of her natural life

Also I give and bequeath unto my Nephew Joseph TURNEY the yearly interest of two hundred pounds at and after the rate of four pounds and ten shillings for one hundred pounds for a year for and during the term of his natural life by four Quarterly payments (that is to say) The feast Day of the Annunciation of the blessed Virgin Mary St John the Baptist Saint Michael the Archangel and Saint Thomas the Apostle in every year the first payment thereof to begin and be made on the first of the said feasts on Days of payment as shall first and next happen after my decease by my Executor herein after named

Also from and after the decease of my said Nephew Joseph TURNEY Then I give and bequeath this said principle sum of two hundred pounds into and amongst all and every child and children of my said Nephew Joseph TURNEY that shall be living at the time of my decease to be equally divided between them share and share alike

Also I give and bequeath unto George TURNEY the late son of my late Nephew George TURNEY the sum of two hundred pounds of like money

Also I give and bequeath unto each of the rest of the Children of my late Nephew George TURNEY that shall be living at the time of my decease the sum of forty pounds apiece of like money

Also I give and bequeath unto James REDMAN and Mary REDMAN the two children of my late Niece Catherine REDMAN the sum of five Guineas apiece of like money

Also I give and bequeath unto my Niece Sarah BUSHBY the sum of five Guineas of like money

Also I give and bequeath unto my Niece Sarah JACKSON the daughter of my late Niece Jane JACKSON the sum of one hundred pounds of like money

Also I give and bequeath unto William SINFIELD and Sarah WHITBREAD the two children of my late Niece Judith SINFIELD the sum of one hundred pounds apiece of like money

Also I give and bequeath unto Mary TURNEY John TURNEY Ann TURNEY Judith TURNEY and George TURNEY the five children of my late Nephew John TURNEY the sum of two hundred pounds of like money to be equally divided between them share and share alike

Also I give and bequeath unto my Nephew Joseph HARRIS the sum of two hundred pounds of like money

Also I give and bequeath unto my Nephew Thomas ROBERTS the sum of ten Guineas of like money Also I give and bequeath unto my Niece Ann ROBERTS the sum of one hundred and fifty pounds of like money to be paid to her by my Executor herein after named whose receipt alone (notwithstanding her Coverture) shall be a good Discharge to my said Executor It being my Will and meaning that the said Legacy or sum of one hundred and fifty pounds shall be at the sole and only disposal of my said Niece Ann ROBERTS (notwithstanding herein Coverture) and not subject to the Debts or Control of her present Husband

Also I give and bequeath unto my Nephew George HARRIS the sum of seven hundred pounds of like money subject nevertheless to and charged and chargable to and with the payment of one anuity or sum of five pounds a year unto my Niece and her offspring for and during the term of her natural life

Also I give and bequeath unto Mr William PIKE of Ridgemont aforesaid yeoman the sum of fifty pounds of like money All and every which saw several and respective Legaties by me herein before given and bequeathed to the several and respective Lagaties herein before named except where I have herein by this my Will otherwise directed the same to be paid.

I do hereby order and direct shall be paid to them by my Executor herein after named out of my Will and personal Estates within twelve Months next after my decease

Also as to all the rest and residue of my Messuages Lands and Tenements and Hereditaments ready Monies Mortgages Bonds Notes Debts Goods Chattels and real and personal Estate and Effects whatsoever and wheresoever and of what nature or kin soever after payment of my just Debts Legaties and funeral Charges and Expenses and the Expenses attending the Execution of this my Will and with which I do hereby charge and make the same Chargeable with the payment of, I give devise and bequeath the same unto my said Nephew George HARRIS his Heirs Executors and Admons to have and to hold the same unto my said Nephew George HARRIS his Heirs Executors Administrators and Assigns forever subject nevertheless to and charged and chargeable to and with the payment of my just Debts Legaties and funeral Charges and Expenses and the Expenses attending the Execution of this my Will and with which I do hereby charge and make chargeable the same with the payment provided also and my Will and meaning further is and I do hereby order and direct that in case the said residue of my real and personal Estate and Effects by this Will given devised and bequeathed to the said George HARRIS my Nephew to for and upon the Trusts and purposes in this my Will mentioned shall happen to fall short and be deficient in Value to the said several Debts and Legaties by me herein before bequeathed to the said several is and respective Legaties herein before named Then and in such Case and I do order and direct that my said Trustee and Executor herein named shall pay to my said several and respective Legaties herein before named except my late Servant Mary IMPEY whom I desire may have her full Legacy of two hundred pounds on the conditions herein in this Will before mentioned, their said several and respective Legacy or Legacies sum and sums of Money in such parts Shares and proportions as the same will amount unto or a Division being made of the same according to their said several and respective Estates and Interests therein As it is my Will and desire that the same shall be divided unto and amongst my said several and respective Legaties herein before named (except as aforesaid) in such proportions only. As a Bankrupts Estate and Effects are usually divided in case of a Deficiency of Assets And my Will and meaning further is and I do hereby order and direct that my said Trustee George HARRIS his Heirs Executors and Administratirs shall retain to and reimburse him and themselves respectively all such Costs Charges Damages and Expenses as he or they shall sustain or be put into and about the Execution of this my Will and the Trusts hereby in him reposed nor shall not nor will not be answerable or accountable for any such Loss Misapplication or Nonapplication of such Trust Moneys as he shall actually receive so as no such Loss happen without his or their own willful Neglect or Default only

Also I do hereby make ordain constitute and appoint my said Nephew George HARRIS sole Executor of this my last Will and Testament hereby revoking and declaring null and void all former and otherWills and Testaments by me at any time herebefore made and do publish and declare this present Writing Contained in this and the two preceeding sheets of paper to be and contain my only last Will and Testament In Witness whereof I the Testator Thomas TURNEY have to this my last Will and Testament set my Hand and Seal that is to say my Hand and Seal at the Top where this and the two preceeding sheets of paper are fastened together and my Hand at the bottom of each of the two preceeding sheets and my Hand and Seal to this sheet this sixteenth day of September in the year of our Lord one thousand and seventy five

This writing was Signed Sealed published and declared by the said Testator Thomas TURNEY as and for his last Will and Testament in our presence who have likewise in his presence and at his request and in the presence of each other subscribe our names as Witnesses thereto

This Will was proved at London the third day of October in the year of our Son one thousand seven hundred and seventy seven before the Worshipful George HARRIS Doctor of Laws and Surrogate of the Right Worshipful Sir George HAY Knight also Doctor of Laws Master Keeper or Commissary of the Perogative Court of Canterbury lawfully constituted by the oath of George HARRIS the Nephew of the deceased and sole Executors named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Codits? of the deceased having been first Sworn duly to Administer.
