Assignment in trust for children
Jane Spitty of South Benfleet, widow and administratrix of Charles
Spitty late of Canvey Island, farmer deceased, to Thomas Spitty of
Bowers Gifford, gentleman, and James Bailey of Gravesend (Kent),
farmer
Northwick Farm on Canvey Island in Prittlewell
To Thomas Spitty and James Bailey in trust to carry on management
of above farm and of Tree Farm in Canvey Island, and out of
profits to pay Jane Spitty annual sum of £100 towards support of
her 4 children, and to invest residue of profits. When Lease of
farm expires, to sell farming stock and implements and household
furniture, and invest money. Third part of trust funds to be paid
to Jane Spitty for her sole use, and after her death to be divided
equally between her daughters Jane and Mary Ann and her younger
son, George. Remaining two thirds of trust funds in trust to be
divided equally between aforesaid children and her elder son,
Charles.
After death of Edward Cox of Brentwood, cabinet maker, father of
Jane Spitty, one moiety of his personal estate which Jane Spitty
will inherit, to Thomas Spitty and James Bailey in trust for Jane
Spitty for her sole use and after her daughter to be divided
equally between her 2 daughters and her younger son.
Recites: (i) Agreement for lease of aforesaid property to Charles
Spitty for term of years of which 8 years are unexpired; (ii) d.
of Charles Spitty, 5 April 1797; (iii) his personal estate valued
at £1,050; (iv) Letters of Administration granted to widow Jane;
(v) Jane Spitty will be entitled to third part of personal estate
of Charles Spitty, deceased, and their children will be entitled
to remaining two third parts

Witnesses: Hannah Powley, William Wall and Mary Britten
Endorsed: 29 July 1805. Assignment by Jane Spitty to Thomas Spitty
and James Bayly (name misspelt in main Indenture) of her share of
the personal estate of Charles Spitty deceased; except household
goods and furniture, in trust to be divided equally between her 2
daughters. Thomas Spitty and James Bayly appointed as guardians to
her daughter Recites: (i) expiration of Lease of aforesaid
property; (ii) d. of George Spitty during his minority; (iii)
Thomas Spitty and James Bayly have paid annual sum of £100 to
Jane Spitty according to trusts, and an additional sum of £50;
(iv) Agreement to pay Jane Spitty £150 which together with other
household furniture will be her share of personal estate of
Charles Spitty, deceased
