Deed –New York Conveyances Recorded for and at the request of Mr. Cornelius Bogert 1st
day of July 1789 This Indenture made the third day of February in the year
of our Lord one thousand seven hundred and eighty nine between John Stites of
the State of New Jersey Merchant and Susannah his wife of the one part and
Cornelius J Bogert of the City of New York Attorney at Law of the other part Witnesseth that the said John Stites and Susannah his wife
for and in consideration of the sum of four hundred and fifty pounds lawful
money of the State of New York to him the said John Stites in hand paid by the
said Cornelius J Bogert at or before the ensealing and delivery of these
presents the receipt whereof is hereby acknowledged have granted bargained sold
aliened released and confirmed and by these presents do grant bargain sell alien
release and confirm unto the said Cornelius J Bogert in his actual possession
now being by virtue of a bargain and sale to him thereof made for one whole year
by Indenture bearing date the day next before the day of the date of these
presents and by force of the Act transferring uses into possession and to his
heirs and assigns forever All that lot of ground situate in Montgomery Ward of the
City of New York and bounded as followsin the front on Beekman Street Together with all ways passages easements profits
hereditaments and advantages to the same belonging And also all the estate right
title dower property interest equity of redemption possession claim and demand
in Law and Equity of them the said John Stites and Susannah his wife and each in
and to the said premises and the reversion and reversions remainder and
remainders rents issues and profits of the said premises with the appurtenances
To have and to hold the said lot of ground and premises hereby granted with the
hereditaments and appurtenances unto the said Cornelius J Bogert his heirs and
assigns to the only proper use and behoof of the said Cornelius J Bogert his
heirs and assigns forever And the said John Stites for himself his heirs executors
and administrators doth hereby covenant and grant to and with the said Cornelius
J Bogert his heirs and assigns that he the said John Stites at and immediately
before the ensealing and delivery of these presents is lawfully and rightfully
seized in his own right of a good sure and indefeasible estate of inheritance in
fee simple in the premises without any limitation of use or uses or any matter
to charge alter or incumber the premises in title estate or otherwise and that
he the said John Stites now hath in himself full power and lawful and absolute
authority to sell and convey the said premises in manner and form aforesaid And also that he the said Cornelius J Bogert his heirs and
assigns shall and may forever hereafter peaceably and quietly have hold use
occupy possess and enjoy the said premises with the appurtenances without the
let suit trouble hindrance molestation interruption or denial of the said John
Stites his heirs or assigns or of any other persons whatsoever having or
lawfully claiming any estate right title or interest of in and to the said
premises with the appurtenances and that free and clear of and from all former
and other gifts grants bargains sales leases wills mortgages or incumbrances
whatsoever And lastly he the said John Stites and his heirs the aforesaid hereby
granted premises with the appurtenances unto the said Cornelius J Bogert his
heirs and assigns against him the said John Stites his heirs and assigns and
against all and every person and persons claiming or to claim the same shall and
will warrant and forever by these presents In witness thereof the parties have hereunto
interchangeably set their hands and seals the day and year first above written John
Stites (seal) Susannah Stites (seal) Sealed and delivered in the presence of the words “his
heirs or assigns” interlined on the first page
Benjamin Haviland, Andw Mitchell Received on the day and year within mentioned the full
consideration money within expressed Be it remembered that on the twenty fifth day of February
in the year of our Lord one thousand seven hundred and eighty nine personally
appeared before me John Ray one of the Masters in Chancery for the State of New
York the within named John Stites and Susannah his wife and the said John Stites
acknowledged that he sealed and delivered the within Indenture of release as his
voluntary act and deed for uses within mentioned And the said Susannah Stites
being also examined by me apart from her husband acknowledged that she sealed
and delivered the within release as her voluntary act and deed for the uses
within mentioned without any fear threat or compulsion from her said husband and
I having inspected the same and finding no razures or interlineations therein
but those noted Do allow the same to be recorded the words “apart from her
